TERMS & CONDITIONS

Introduction

These Terms & Conditions govern the rental and use of vehicles and services provided by ZEAL Unipessoal, Lda. (“ZEAL Car Rentals”). By booking, renting, or using ZEAL’s vehicles or services, the client agrees to comply with these Terms & Conditions.
ZEAL reserves the right to amend or update these Terms & Conditions at any time without prior notice.

Scope of Services

ZEAL provides vehicle rental services with or without professional drivers, including short-term rentals, long-term leasing, and transportation support for government institutions, international organizations, private sector companies, events, and individual clients.
All services are subject to vehicle availability and the terms agreed at the time of booking.

Vehicle Delivery, Condition, and Inspection

All cars are handed over to the client in safe, roadworthy, and good operating condition, fully inspected and ready for use.
A joint inspection of the car’s condition, accessories, and facilities (including air conditioning, audio system, spare tire, wheel tools, and other standard equipment) shall be conducted at the time of handover.
The inspection record shall serve as the reference condition for the return of the car at the end of the rental period.

Rental Period and Extensions

The rental period begins and ends on the dates and times agreed at the time of booking.
Rental duration may be calculated by days, weeks, or months, depending on the agreement.
Any extension of the rental period must be communicated and approved by ZEAL in advance.
Failure to communicate an extension before the rental period expires will be treated as an automatic extension, and the client shall be required to pay additional rental charges accordingly.

Pricing and Payment

Rental prices are agreed prior to vehicle use.
Payment must be made before or at the start of the rental period, unless otherwise agreed in writing.
Payments may be made in cash or via bank transfer, as agreed with ZEAL.
In the event of damage, accident, or loss, the client is responsible for all repair or replacement costs exceeding any security deposit or insurance coverage.
ZEAL reserves the right to suspend or terminate services in case of delayed or non-payment.

Vehicle Condition, Maintenance, and Replacement

ZEAL guarantees that all cars are provided in good mechanical condition and suitable for use.
If a car becomes inoperable due to mechanical failure not caused by the client, ZEAL may provide a replacement vehicle, subject to availability.
Where repairs are expected to exceed twelve (12) hours due to mechanical issues not attributable to the client, ZEAL will make reasonable efforts to provide a replacement car.
Minor repairs conducted outside Dili (such as filters, light bulbs, brake components) may be carried out by the client up to a reasonable cost limit, subject to later reimbursement approval by ZEAL.

Fuel Policy

Rental prices do not include fuel unless otherwise agreed.
ZEAL provides cars with a full fuel tank at the beginning of the rental period.
It is obligatory for the client to refill the fuel tank before returning the car.
Failure to return the car with a full tank will result in additional fuel and service charges.

Driver-Inclusive Rentals and Language Support

Where a driver is provided, the driver’s role is limited to professional transportation services only. ZEAL drivers are not tour guides or interpreters.

Drivers primarily communicate in Tetum and Bahasa Indonesia. Clients requiring English-speaking assistance or guided sightseeing services must arrange licensed interpreters or tour guides separately. ZEAL may assist with recommendations upon request.

Client Responsibilities

Clients shall:

Use the vehicle responsibly and in accordance with traffic laws
Take proper care of the rented car throughout the rental period
Inform ZEAL immediately (within one hour where possible) in the event of damage, accident, or loss
Report accidents, theft, or loss to the nearest police station without delay

Prohibited Use of Vehicles

Clients are strictly prohibited from using ZEAL vehicles for:

Driving lessons or training activities
Racing, speed testing, or performance testing
Renting, selling, pawning, or transferring the vehicle to a third party without written approval
Illegal activities or actions, including trafficking or actions contrary to the laws of Timor-Leste

ZEAL reserves the right to terminate the rental agreement immediately without refund if prohibited use is identified.

Accidents, Damage, and Loss

In the event of an accident, the client remains financially responsible for rental charges during the repair period.
If the car cannot be repaired or is deemed a total loss, the client shall be required to replace the car with one of similar specifications or compensate ZEAL accordingly.
If a car is lost or stolen, the client bears full responsibility and shall not be entitled to a replacement vehicle.
Loss of vehicle documents shall be the client’s financial responsibility, including processing costs and loss of use during replacement.

Third-Party Use

The client may not lend or allow use of the rented car to a third party without prior written approval from ZEAL.
Any damage, accident, or loss occurring during unauthorized third-party use remains the full responsibility of the client.

Insurance and Liability

All ZEAL vehicles are insured through Federal Insurance Timor S.A., in accordance with applicable laws and industry regulations in Timor-Leste.
Insurance coverage is intended to provide protection against unforeseen incidents during the rental period.
Specific insurance coverage terms, excess amounts, and renter responsibilities are outlined in the individual rental agreement and explained at the time of booking.
Clients may be responsible for insurance excess amounts, uncovered damages, or costs resulting from misuse, negligence, accidents, or illegal activities.
ZEAL Car Rentals is not liable for personal belongings left inside the vehicle during or after the rental period.

Cancellations

If a confirmed booking is cancelled after ZEAL has prepared or delivered the car within the Dili area, a cancellation fee of up to twenty percent (20%) of one day’s rental may apply.
For long-term rentals, cancellation fees may apply based on the period of vehicle use prior to cancellation.

Enforcement and Recovery

If the client fails to fulfill payment obligations, ZEAL reserves the right to recover outstanding amounts through lawful means, including withholding assets or pursuing legal remedies in accordance with Timor-Leste law.

Limitation of Liability

ZEAL’s liability is limited to the value of the rental agreement. ZEAL shall not be liable for indirect, incidental, or consequential damages arising from the use of its services.

Governing Law and Dispute Resolution

These Terms & Conditions are governed by the laws of the Democratic Republic of Timor-Leste.
Any dispute arising from these Terms & Conditions shall first be resolved through amicable negotiation or mediation.
If unresolved, disputes may be referred to the courts of the Democratic Republic of Timor-Leste.
